1. Who we are

whip.to (the “Site”) is operated by Saturn Program Returns Pty Ltd (“Whip”, “we”, “us” or “our”) of 330 Bridge Road, Richmond VIC 3121, Australia. You can contact us at hi@whip.to.

2. Agreeing to these terms

By using the Site you agree to these terms. Our Privacy Policy explains how we handle personal information. If you don’t agree to these terms, please don’t use the Site.

3. Whip isn’t available yet

The Site previews a product that is still being built. Nothing on the Site is an offer to supply goods or services. Features, pricing, timing and availability aren’t settled and may change, or may not happen at all. Joining the early access list doesn’t guarantee you access to Whip and doesn’t oblige you or us to supply or buy anything.

4. The early access list

When you join the list, you:

• confirm that the email address is yours, or that you’re authorised to use it; and
• agree that we can email you about Whip, including launch news, early access invitations and requests for feedback.

Every email we send tells you how to unsubscribe. You can also ask us to remove you at any time by emailing hi@whip.to.

5. Using the Site

You must not:

• use the Site for anything unlawful, misleading or harmful;
• submit another person’s details without their permission, or submit fake, automated or bulk sign-ups;
• interfere with, overload or disrupt the Site or the systems behind it;
• try to gain unauthorised access to the Site, our systems or anyone’s data;
• upload or transmit malicious code; or
• copy or scrape content from the Site by automated means, other than search engine indexing that follows our robots.txt file.

6. Our content

The Site and its content, including text, images, graphics, logos and the Whip name, belong to us or our licensors and are protected by intellectual property laws. You may view the Site and share links to it. Any other use of our content, including copying, reproducing or adapting it, needs our written permission, except where the law allows it.

7. Feedback

If you send us ideas, suggestions or feedback, we may use them for any purpose without paying you or owing you anything for them.

8. Other websites

The Site may link to websites run by other people. We don’t control those websites and aren’t responsible for their content, availability or privacy practices.

9. Your rights under the Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted or modified (your “Non-excludable Rights”). These terms apply subject to your Non-excludable Rights.

10. No other promises

Subject to your Non-excludable Rights, the Site is provided “as is” and “as available”. We don’t promise that the Site will always be available, uninterrupted, secure or error-free, or that its content is complete, accurate or up to date.

11. Limits on our liability

To the maximum extent permitted by law, and subject to your Non-excludable Rights:

• we aren’t liable for any indirect or consequential loss arising from or in connection with the Site or these terms; and
• where our liability for failing to comply with a consumer guarantee can lawfully be limited, it is limited to supplying the relevant services again or paying the cost of having them supplied again.

12. Changes to these terms

We may update these terms by publishing a new version on this page, with the date at the top showing when they last changed. If a change is material, we’ll give reasonable notice before it takes effect, for example on this page or by emailing the early access list. If you don’t agree with an update, you can stop using the Site and ask us to take you off the list.

13. Governing law

These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts that can hear appeals from them.
